Welcome to BuildView
These Terms of Service ("Terms") govern your use of the BuildView platform (the "Service"). By creating an account or using BuildView, you agree to these Terms. If you don't agree, don't use the Service.

1. Acceptance of Terms
By accessing or using BuildView, you agree to:
- These Terms of Service
- Our Privacy Policy (www.buildview.ai/privacy)
- Any additional guidelines or rules we post
These Terms apply to all users: homeowners, contractors, admins, and visitors.
2. Eligibility
To use BuildView, you must:
- Be at least 18 years old
- Have the legal capacity to enter into a binding contract
- Not be prohibited from using the Service under applicable laws
By registering, you represent and warrant that you meet these requirements.
3. Account Registration
3.1 Creating an Account
- Provide accurate, complete, and current information
- Choose a strong password
- Keep your login credentials confidential
- Notify us immediately if your account is compromised (team@buildview.ai)
3.2 Account Responsibility
- You're responsible for all activity under your account
- We're not liable for losses resulting from unauthorized use
- You may not share your account or transfer it to others without our consent
3.3 Account Termination
- You can close your account anytime by emailing team@buildview.ai
- We may suspend or terminate your account if you violate these Terms
4. Service Description
BuildView provides a construction management platform that enables homeowners and contractors to:
- Track project progress via Story View updates
- Manage approvals for change orders and decisions
- Communicate through organized message channels
- Visualize projects in 2D/3D/360° views
- Store and search project documents
- Get AI-powered assistance
We reserve the right to modify, suspend, or discontinue any feature at any time, with or without notice.
5. Subscription & Payment
5.1 Pricing
- Premium Tier: $400-750/month for $1-3M projects
- Luxury Tier: $900-1,800/month for $3M+ projects
- Contractor Add-On: $99/month per contractor (3 free per project)
- Pricing is subject to change with 30 days' notice
5.2 Billing
- Subscriptions are billed monthly in advance
- Payments are processed via our third-party payment processor (Stripe)
- You authorize us to charge your payment method automatically
- All fees are non-refundable except as required by law
5.3 Free Trial
- We may offer a free trial (terms specified at signup)
- We'll notify you before charging your payment method
- Cancel anytime during the trial to avoid charges
5.4 Cancellation
- Cancel your subscription anytime (no penalties)
- Access continues until the end of your billing period
- No refunds for partial months
5.5 Taxes
- Prices exclude taxes
- You're responsible for applicable sales, use, or VAT taxes
6. Acceptable Use
You agree NOT to:
✘ Violate any laws, regulations, or third-party rights
✘ Upload viruses, malware, or malicious code
✘ Spam, harass, or abuse other users
✘ Impersonate others or provide false information
✘ Scrape, crawl, or use bots to access the Service
✘ Reverse engineer, decompile, or hack the Service
✘ Use the Service for illegal purposes (e.g., money laundering, fraud)
✘ Upload content that infringes copyrights, trademarks, or other intellectual property
✘ Upload obscene, defamatory, or hate speech content
✘ Interfere with the Service's operation or security
Violation of these rules may result in account suspension or termination.
7. User Content
7.1 Your Content
- You retain ownership of all photos, videos, documents, messages, and other content you upload ("Your Content")
- You grant BuildView a worldwide, non-exclusive, royalty-free license to use, store, reproduce, and display Your Content to provide the Service
- This license ends when you delete Your Content or close your account (except for backups)
7.2 Content Responsibility
- You're solely responsible for Your Content
- You represent that you have the rights to upload Your Content and that it doesn't violate any laws or third-party rights
- We're not responsible for user-generated content
7.3 Content Removal
- We may remove content that violates these Terms or applicable laws
- We're not obligated to monitor or review all content, but we reserve the right to do so
7.4 Backup Your Content
- While we back up data regularly, you're responsible for keeping your own backups of important content
8. Intellectual Property
8.1 BuildView's IP
- The Service, including all software, design, text, graphics, logos, and trademarks, is owned by BuildView or our licensors
- These Terms don't grant you any ownership rights
8.2 Limited License
- We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or business construction projects
- You may not copy, modify, distribute, sell, or create derivative works without our written permission
8.3 Trademarks
- "BuildView" and our logo are trademarks of BuildView, Inc.
- You may not use our trademarks without permission
9. Third-Party Integrations
9.1 Contractor Tools
- BuildView integrates with third-party contractor tools (Procore, Buildertrend, etc.)
- You're responsible for complying with those tools' terms of service
- We're not responsible for issues arising from third-party integrations
9.2 Third-Party Services
- The Service uses third-party services (OpenAI, Matterport, Stripe, etc.)
- We're not responsible for their performance or policies
- Your use of these services is subject to their terms
9.3 Links to Other Websites
- The Service may contain links to external websites
- We don't endorse or control these sites and aren't responsible for their content
10. AI Features & Accuracy
10.1 AI Assistant
- Our AI Assistant uses artificial intelligence to answer questions and provide suggestions
- AI responses may not always be accurate, complete, or up-to-date
- Don't rely solely on AI for critical decisions (e.g., legal, financial, or safety matters)
10.2 No Professional Advice
- BuildView doesn't provide legal, financial, architectural, or engineering advice
- Consult qualified professionals for important decisions
10.3 OCR & Document Search
- Our document search uses OCR (optical character recognition) to extract text
- OCR may produce errors—always verify important information
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We disclaim all warranties, including:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- That the Service will be uninterrupted, error-free, or secure
- That results obtained from the Service will be accurate or reliable
You use the Service at your own risk.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- BuildView, its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages
- This includes damages for lost profits, data loss, business interruption, or other intangible losses
- Our total liability to you for any claims related to the Service is limited to the amount you paid us in the 12 months before the claim
Some jurisdictions don't allow these limitations, so they may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless BuildView, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights (e.g., copyright infringement)
- Content you upload
14. Dispute Resolution
14.1 Governing Law
- These Terms are governed by the laws of NEW YORK, NY without regard to conflict of law principles
14.2 Informal Resolution
- Before filing a lawsuit, you agree to contact us at team@buildview.ai to resolve the dispute informally
14.3 Arbitration (Optional)
- If informal resolution fails, disputes will be resolved through binding arbitration (except where prohibited by law)
- Arbitration will be conducted by [Arbitration Organization] under its rules
- Each party pays their own costs
14.4 Class Action Waiver
- You agree to resolve disputes individually, not as part of a class action or collective lawsuit
14.5 Exceptions
- Either party may seek injunctive relief in court (e.g., to prevent unauthorized use of intellectual property)
15. Changes to These Terms
We may update these Terms from time to time. We'll notify you of material changes via:
- Email to your registered address
- In-app notification
- Posting the updated Terms on our website
Continued use after changes constitutes acceptance of the new Terms. If you don't agree, stop using the Service and close your account.
16. General Provisions
16.1 Entire Agreement
- These Terms, along with our Privacy Policy, constitute the entire agreement between you and BuildView
16.2 Severability
- If any provision is found invalid or unenforceable, the remaining provisions remain in effect
16.3 Waiver
- Our failure to enforce any right or provision doesn't constitute a waiver
16.4 Assignment
- You may not assign these Terms without our consent
- We may assign these Terms (e.g., in a merger or acquisition)
16.5 Force Majeure
- We're not liable for delays or failures due to events beyond our reasonable control (e.g., natural disasters, pandemics, wars)
16.6 Survival
- Provisions that by their nature should survive (e.g., disclaimers, limitation of liability, indemnification) remain in effect after termination
